01Agreement本契約への同意

By installing or using LUFSBar Pro (“the Software”), you agree to this Licence. If you do not agree, do not install or use the Software.LUFSBar Pro（以下「本ソフトウェア」）をインストールまたは使用することにより、お客様は本契約に同意したものとみなされます。同意されない場合は、インストール・使用をお控えください。

The Software is provided by tokyomeltdown (“we”, “us”). Payment is processed by Gumroad, which acts as the merchant of record.本ソフトウェアは tokyomeltdown が提供します。決済は Gumroad が Merchant of Record として処理します。

02Licence grant使用許諾

We grant you a non-exclusive, non-transferable licence to install and use the Software on Macs that you own or control, up to the activation limit shown in the app (currently 5).お客様が所有または管理する Mac に対し、アプリ内に表示される認証台数の上限（現在は5台）まで、本ソフトウェアをインストールし使用する非独占的・譲渡不可の権利を許諾します。

Each activation is counted when you enter your licence key on a Mac. If you need to move your licence to a new Mac after reaching the limit, contact us and we will reset it.認証は、Mac 上でライセンスキーを入力した時点で1台分としてカウントされます。上限に達した後で新しい Mac へ移す必要が生じた場合は、当方までご連絡ください。リセットいたします。

This is a licence, not a sale of the Software itself.これは使用許諾であり、本ソフトウェアそのものの売買ではありません。

03Trialトライアル

The Software includes a 14-day trial with full functionality. When the trial expires, loudness measurement stops until a valid licence key is entered. The trial period is tracked locally on your Mac.本ソフトウェアには全機能を使える14日間のトライアル期間があります。期間終了後、有効なライセンスキーを入力するまでラウドネスの測定は停止します。期間はお客様の Mac 上でローカルに管理されます。

A separate free version, LUFSBar, is published under the MIT licence and is not covered by this Licence.無料版の LUFSBar は MIT ライセンスで別途公開されており、本契約の対象外です。

04Restrictions禁止事項

You may not:以下の行為を禁じます。

• redistribute, resell, rent, or sublicense the Software再配布・再販売・貸与・サブライセンス
• share your licence key publiclyライセンスキーの公開・共有
• decompile, disassemble, or reverse engineer the Software, except where such restriction is prohibited by applicable law逆コンパイル・逆アセンブル・リバースエンジニアリング（法令により制限が禁じられている場合を除く）
• remove or alter any notices contained in the Software, including the third-party notices shown in Settings本ソフトウェア内の表示の削除・改変（設定画面に表示される第三者ライセンス表記を含む）

05Ownership権利の帰属

We retain all rights, title, and interest in the Software. The source code is not published.本ソフトウェアに関する一切の権利は当方に帰属します。ソースコードは公開していません。

06Your audioお客様の音声について

The Software measures the audio playing on your Mac. It does not record that audio and does not write it to disk. Audio is processed in memory and discarded.本ソフトウェアは Mac で再生されている音声を測定します。その音声を録音せず、ディスクにも書き出しません。音声はメモリ上で処理され、破棄されます。

07Third-party plug-ins第三者プラグインについて

The Software can load Audio Unit effect plug-ins that are installed on your Mac. Those plug-ins are made by other people. We did not write them, we do not test them, and we claim no rights over them.本ソフトウェアは、お客様の Mac にインストールされている Audio Unit エフェクトプラグインを読み込むことができます。それらのプラグインは他者が制作したものです。当方は制作しておらず、動作検証も行っておらず、いかなる権利も主張しません。

A plug-in you insert runs inside the Software. A defective or incompatible plug-in can crash the Software, corrupt the audio it produces, or make the measurement wrong. We are not responsible for the behaviour of third-party plug-ins, and your use of them is governed by their own licences, not by this Licence.インサートしたプラグインは本ソフトウェアの内部で動作します。不具合のあるプラグインや非互換のプラグインは、本ソフトウェアをクラッシュさせ、音声を破損させ、測定値を誤らせることがあります。当方は第三者プラグインの挙動について責任を負いません。それらの利用は、本契約ではなく各プラグインのライセンスに従います。

08Measurement and audio output測定と音声出力について

The Software reports loudness values computed with the EBU R 128 / ITU-R BS.1770 algorithm. Those values depend on what audio actually reaches the Software, on your system audio configuration, and on any plug-ins you have inserted.本ソフトウェアは EBU R 128 / ITU-R BS.1770 のアルゴリズムでラウドネス値を算出します。その値は、実際に本ソフトウェアへ届いた音声・システムの音声設定・インサートしたプラグインに左右されます。

09Privacy and network useプライバシーと通信

The Software runs locally. It does not upload your audio, your settings, or the contents of your screen anywhere.本ソフトウェアはローカルで動作します。音声・設定・画面の内容を、どこにもアップロードしません。

The only network request the Software makes is to Gumroad's licence verification endpoint, and only when you activate a licence key. After activation, the Software works offline.本ソフトウェアが行う唯一の通信は、ライセンスキーを認証するときの Gumroad の検証エンドポイントへのリクエストのみです。認証後はオフラインで動作します。

When you tap a link in Settings, the Software opens that page in your default browser. That request is made by your browser, not by the Software.設定画面のリンクを押した場合、本ソフトウェアは既定のブラウザで該当ページを開きます。その通信を行うのはブラウザであり、本ソフトウェアではありません。

The Software contains no analytics, telemetry, or crash reporting libraries.解析・計測・クラッシュレポートのライブラリは一切含みません。

The Software requests permission to capture system audio, and uses it only to measure and, if you enable it, to pass that audio through your insert chain. It does not monitor keystrokes and does not request Input Monitoring permission.本ソフトウェアはシステム音声を取り込む権限を要求し、これを測定と、お客様が有効にした場合のインサートチェーンへのパススルーにのみ使用します。キー入力の監視は行わず、入力監視の権限も要求しません。

Your settings and insert chain are stored locally on your Mac. Your licence key is stored locally in the macOS Keychain.設定とインサート構成はお客様の Mac にローカル保存されます。ライセンスキーは macOS の Keychain にローカル保存されます。

10No warranty無保証

The Software is provided “as is”, without warranty of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.本ソフトウェアは現状有姿で提供され、商品性・特定目的への適合性・第三者の権利を侵害しないことを含め、明示黙示を問わずいかなる保証も行いません。

We do not warrant that the Software will be error-free, that measurements will be correct in every configuration, or that it will work with every audio interface, plug-in, macOS version, or configuration.エラーがないこと、あらゆる環境で測定値が正しいこと、また、あらゆるオーディオインターフェース・プラグイン・macOSバージョン・環境で動作することを保証しません。

This section does not limit any rights you have under consumer protection law that cannot be waived.本条は、消費者保護法令上、放棄できない権利を制限するものではありません。

11Limitation of liability責任の制限

To the extent permitted by applicable law, our total liability arising out of or relating to the Software is limited to the amount you paid for it.適用される法令が許す範囲において、本ソフトウェアに関する当方の責任の総額は、お客様が支払った金額を上限とします。

We are not liable for lost work, lost data, rejected deliveries, lost profits, or other indirect or consequential damages.作業データの消失、データの消失、納品の不合格、逸失利益、その他の間接的・結果的な損害について責任を負いません。

This section does not exclude liability that cannot be excluded under applicable law.法令上排除できない責任を排除するものではありません。

12Refunds返金

Sales are final. This is stated at the point of purchase. The 14-day trial exists so that you can fully evaluate the Software before paying.返金は行いません。これは購入時にも明示しています。支払う前に十分に評価いただけるよう、14日間のトライアルを用意しています。

Statutory rights that cannot be waived are unaffected. Where a refund is required by law, or where Gumroad's own policy applies, those apply.法令上放棄できない権利には影響しません。法令により返金が必要な場合、または Gumroad 自身のポリシーが適用される場合は、それらに従います。

13Termination契約の終了

This licence ends if you breach it. On termination you must stop using the Software and remove it from your Macs.本契約に違反した場合、使用許諾は終了します。終了後は使用を停止し、お客様の Mac から削除してください。

14Changes変更

We may update the Software and this Licence. Continued use of a new version after an update constitutes acceptance of the then-current Licence. Existing licence keys remain valid across versions.本ソフトウェアおよび本契約は更新されることがあります。更新後のバージョンを継続して使用した場合、その時点の契約に同意したものとみなされます。既存のライセンスキーはバージョンをまたいで有効です。

15Governing law準拠法

This Licence is governed by the laws of Japan. This does not deprive you of the protection of mandatory consumer law in your country of residence.本契約は日本法に準拠します。お客様の居住国における強行的な消費者保護法令による保護を奪うものではありません。

16Third-party components第三者コンポーネント

Apart from frameworks provided by Apple as part of macOS (Core Audio, AVFoundation, SwiftUI and others), the Software includes the following third-party component:Apple が macOS の一部として提供するフレームワーク（Core Audio / AVFoundation / SwiftUI 等）のほか、本ソフトウェアは以下の第三者コンポーネントを含みます。

The full text of the MIT licence for libebur128 is included with the Software and can be read in Settings.libebur128 の MIT ライセンス全文は本ソフトウェアに同梱されており、設定画面から読むことができます。

Audio Unit plug-ins that you install yourself are not components of the Software. See §7.お客様ご自身がインストールした Audio Unit プラグインは、本ソフトウェアの構成要素ではありません。§7 をご覧ください。
