By installing or using EQ Mirror ("the Software"), you agree to this License. If you do not agree, do not install or use the Software.

The Software is provided by tokyomeltdown ("we", "us"). Payment is processed by Gumroad, which acts as the merchant of record.

We grant you a non-exclusive, non-transferable licence to install and use the Software on Macs that you own or control, up to the activation limit shown in the Software (currently 5).

The Software is used as a pair of plug-in instances. Any number of pairs may be used on an activated Mac.

This is a licence, not a sale of the Software itself.

The Software includes a 14-day trial with full functionality. The trial begins the first time you open the EQ Mirror window on your Mac, not when your host scans its plug-ins. When the trial expires, the Software stops measuring until a valid licence key is entered: the curve is no longer updated, and a notice asks for a licence key. Audio continues to pass through unchanged. The trial period is tracked locally on your Mac.

You may not:

• redistribute, resell, rent, or sublicense the Software
• share your licence key publicly
• decompile, disassemble, or reverse engineer the Software, except where such restriction is prohibited by applicable law
• remove or alter any notices contained in the Software

We retain all rights, title, and interest in the Software. The source code is not published. Third-party components remain the property of their owners and are licensed under their own terms (§15).

Your projects, recordings, and mixes are yours. We claim no rights over them.

The Software measures; it does not process. Audio passes through both instances unchanged. Inserting it, bypassing it, or removing it does not change what your session sounds like.

The curve, the tags, and the distortion figure the Software displays are measurements estimated from the audio that passes through it. They depend on the material and can be wrong, particularly while a measurement is still settling, on very narrow filters, and at the bottom of the frequency range. Decisions you make on the basis of these readings are yours.

The Software runs locally. It does not upload your audio, your project, or anything about your session.

To form a pair, the Software reads the name of the track it is inserted on, as provided by your host application. The name is used in memory only; it is not stored or sent anywhere.

Settings are stored inside your host project by your host application: the window size, which pair an instance belongs to, and, if you have changed it by hand, which half of the pair it is. The Software does not otherwise read or write files on your Mac, except for the licence information described below.

The only network request the Software makes is to Gumroad's licence verification endpoint, and only when you activate a licence key. After activation, the Software works offline.

Your licence information -- the date your trial began, when the Software last checked it, and, once you enter one, your licence key together with a check value made from the key and your Mac's hardware identifier -- is stored locally on your Mac in two files: ~/Library/Application Support/tokyomeltdown/EQ Mirror/licence.json and ~/Library/Preferences/com.tokyomeltdown.eqmirror.licence.json. The hardware identifier itself is not stored or sent anywhere.

The Software contains no analytics, telemetry, or crash reporting libraries.

The Software is provided "as is", without warranty of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, accuracy of measurement, and non-infringement.

We do not warrant that the Software will be error-free or that it will work with every host application, plug-in, macOS version, or configuration.

This section does not limit any rights you have under consumer protection law that cannot be waived.

To the extent permitted by applicable law, our total liability arising out of or relating to the Software is limited to the amount you paid for it.

We are not liable for lost data, lost projects, lost profits, or other indirect or consequential damages.

This section does not exclude liability that cannot be excluded under applicable law.

Sales are final. This is stated at the point of purchase. The 14-day trial exists so that you can fully evaluate the Software before paying.

Statutory rights that cannot be waived are unaffected. Where a refund is required by law, or where Gumroad's own policy applies, those apply.

This licence ends if you breach it. On termination you must stop using the Software and remove it from your Macs.

We may update the Software and this License. Continued use of a new version after an update constitutes acceptance of the then-current License. Existing licence keys remain valid across versions.

This License is governed by the laws of Japan. This does not deprive you of the protection of mandatory consumer law in your country of residence.

The Software is built with the JUCE framework and includes the following third-party components. Each is the property of its respective owner and is used under its own licence. The full notices are provided in the file THIRD_PARTY_NOTICES.txt that accompanies the Software.
