01Agreement本契約への同意

By installing or using caps REC (“the Software”), you agree to this Licence. If you do not agree, do not install or use the Software.caps REC（以下「本ソフトウェア」）をインストールまたは使用することにより、お客様は本契約に同意したものとみなされます。同意されない場合は、インストール・使用をお控えください。

The Software is provided by tokyomeltdown. Payment is processed by Gumroad, which acts as the merchant of record.本ソフトウェアは tokyomeltdown が提供します。決済は Gumroad が Merchant of Record として処理します。

02Licence grant使用許諾

We grant you a non-exclusive, non-transferable licence to install and use the Software on Macs that you own or control, up to the activation limit shown in the app (currently 5).お客様が所有または管理する Mac に対し、アプリ内に表示される認証台数の上限（現在は5台）まで、本ソフトウェアをインストールし使用する非独占的・譲渡不可の権利を許諾します。

This is a licence, not a sale of the Software itself.これは使用許諾であり、本ソフトウェアそのものの売買ではありません。

03Trialトライアル

The Software includes a 14-day trial with full functionality. When the trial expires, recording stops until a valid licence key is entered. The trial period is tracked locally on your Mac.本ソフトウェアには全機能を使える14日間のトライアル期間があります。期間終了後、有効なライセンスキーを入力するまで録画は停止します。期間はお客様の Mac 上でローカルに管理されます。

04Restrictions禁止事項

• Redistributing, reselling, renting, or sublicensing the Software再配布・再販売・貸与・サブライセンス
• Sharing your licence key publiclyライセンスキーの公開・共有
• Decompiling, disassembling, or reverse engineering the Software, except where such restriction is prohibited by applicable law逆コンパイル・逆アセンブル・リバースエンジニアリング（法令により制限が禁じられている場合を除く）
• Removing or altering any notices contained in the Software本ソフトウェア内の表示の削除・改変

05Ownership権利の帰属

We retain all rights, title, and interest in the Software. The source code is not published.本ソフトウェアに関する一切の権利は当方に帰属します。ソースコードは公開していません。

06Your recordings録画データについて

Recordings you make with the Software are yours. We claim no rights over them.本ソフトウェアで録画したデータはお客様のものです。当方はいかなる権利も主張しません。

You are responsible for what you record. Screen recording may capture copyrighted material, confidential information, or other people’s voices. Laws about recording vary by country and situation. Make sure you have the right to record what you are recording.何を録画するかについての責任はお客様にあります。画面録画は、著作物・機密情報・第三者の音声などを含み得ます。録音・録画に関する法令は国や状況によって異なります。録画する対象について、録画する権利があることをご確認ください。

07Privacy and network useプライバシーと通信

The Software runs locally. It does not upload your recordings, screen contents, or audio anywhere.本ソフトウェアはローカルで動作します。録画データ・画面の内容・音声を、どこにもアップロードしません。

The only network request the Software makes is to Gumroad’s licence verification endpoint, and only when you activate a licence key. After activation, the Software works offline.本ソフトウェアが行う唯一の通信は、ライセンスキーを認証するときの Gumroad の検証エンドポイントへのリクエストのみです。認証後はオフラインで動作します。

When you tap the purchase button or the licence terms button, the Software opens that page in your default browser. That request is made by your browser, not by the Software.購入ボタンまたは利用規約ボタンを押した場合、本ソフトウェアは既定のブラウザで該当ページを開きます。その通信を行うのはブラウザであり、本ソフトウェアではありません。

The Software contains no analytics, telemetry, or crash reporting libraries.解析・計測・クラッシュレポートのライブラリは一切含みません。

The Software reads the caps lock indicator state to trigger recording. It does not monitor keystrokes and does not request Input Monitoring permission.録画の開始判定には caps lock のランプ状態を読み取ります。キー入力の監視は行わず、入力監視の権限も要求しません。

08No warranty無保証

The Software is provided “as is”, without warranty of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.本ソフトウェアは現状有姿で提供され、商品性・特定目的への適合性・第三者の権利を侵害しないことを含め、明示黙示を問わずいかなる保証も行いません。

We do not warrant that the Software will be error-free or that it will work with every audio interface, macOS version, or configuration.エラーがないこと、また、あらゆるオーディオインターフェース・macOSバージョン・環境で動作することを保証しません。

This section does not limit any rights you have under consumer protection law that cannot be waived.本条は、消費者保護法令上、放棄できない権利を制限するものではありません。

09Limitation of liability責任の制限

To the extent permitted by applicable law, our total liability arising out of or relating to the Software is limited to the amount you paid for it.適用される法令が許す範囲において、本ソフトウェアに関する当方の責任の総額は、お客様が支払った金額を上限とします。

We are not liable for lost recordings, lost data, lost profits, or other indirect or consequential damages.録画データの消失、データの消失、逸失利益、その他の間接的・結果的な損害について責任を負いません。

This section does not exclude liability that cannot be excluded under applicable law.法令上排除できない責任を排除するものではありません。

10Refunds返金

Sales are final. This is stated at the point of purchase. The 14-day trial exists so that you can fully evaluate the Software before paying.返金は行いません。これは購入時にも明示しています。支払う前に十分に評価いただけるよう、14日間のトライアルを用意しています。

Statutory rights that cannot be waived are unaffected. Where a refund is required by law, or where Gumroad’s own policy applies, those apply.法令上放棄できない権利には影響しません。法令により返金が必要な場合、または Gumroad 自身のポリシーが適用される場合は、それらに従います。

11Termination契約の終了

This licence ends if you breach it. On termination you must stop using the Software and remove it from your Macs.本契約に違反した場合、使用許諾は終了します。終了後は使用を停止し、お客様の Mac から削除してください。

12Changes変更

We may update the Software and this Licence. Continued use of a new version after an update constitutes acceptance of the then-current Licence. Existing licence keys remain valid across versions.本ソフトウェアおよび本契約は更新されることがあります。更新後のバージョンを継続して使用した場合、その時点の契約に同意したものとみなされます。既存のライセンスキーはバージョンをまたいで有効です。

13Governing law準拠法

This Licence is governed by the laws of Japan. This does not deprive you of the protection of mandatory consumer law in your country of residence.本契約は日本法に準拠します。お客様の居住国における強行的な消費者保護法令による保護を奪うものではありません。

14Third-party components第三者コンポーネント

The Software uses only frameworks provided by Apple as part of macOS (ScreenCaptureKit, AVFoundation, SwiftUI, Core Audio and others). It bundles no third-party open source libraries requiring attribution.本ソフトウェアは、Apple が macOS の一部として提供するフレームワーク（ScreenCaptureKit / AVFoundation / SwiftUI / Core Audio 等）のみを使用しています。ライセンス表記が必要な第三者のオープンソースライブラリは組み込んでいません。
